These Terms & Conditions apply to your use of lumberjackjoe.com and to any services provided by Lumberjack Joe (Joe Taylor). These terms stand and apply to all quotes, bookings, and services. From time to time, specific projects may require a separate, bespoke written contract; in these instances, the terms of that specific contract will overrule these general terms where they conflict. By using this website or working with me, you agree to these terms. If you do not agree, please do not use the site.

2. Use of This Website

You may browse this website for personal or business reference. You agree not to:

  • Copy or reproduce any content without written permission.

  • Attempt to hack, disrupt, or misuse the site.

  • Use contact forms for spam or unlawful activity.

  • Website content may change without notice.

3. Intellectual Property, Resale & AI Training

All content on this website—including text, images, logos, branding, artwork, photographs, illustrations, and project examples—is owned by or used with permission by LumberJackJoe/Lumber Studio, unless stated otherwise.

You must not:

  • Copy, edit, reproduce, or distribute any content without permission.

  • Take my intellectual property (IP) and use it for resale or your own financial gain without explicit written permission and the purchase of an appropriate commercial licence.

  • Use portfolio images or client work for your own promotional use.

  • Use, scrape, or harvest any content, artwork, or photography from this website or my final deliverables to train Artificial Intelligence (AI) models or machine learning systems.

Clients retain rights only to the final approved work as outlined in their individual project agreement.

4. Service Agreements

All commissioned work (design, photography, illustration, art direction, or other services) is subject to a written project proposal or quote. This may include scope of work, deadlines, deliverables, fees and payment schedules, usage rights, and a revisions policy. Work does not begin until the proposal is agreed to and the required deposit is received.

5. Pricing & Payment Terms

  • Prices are quoted on a per-project basis.

  • A 50% non-refundable deposit is required to secure a date in the schedule and commence work.

  • Remaining balances are payable upon delivery of work or within 1 month of receiving the final invoice.

  • Late payments may incur interest in accordance with the UK’s Late Payment of Commercial Debts (Interest) Act 1998.

  • All fees must be paid in full before final files or usage rights are released.

6. Revisions & Changes

  • Quotes include 2 rounds of revisions unless otherwise agreed.

  • Additional revisions or scope changes may incur extra fees.

  • Any major changes after approval of concepts, sketches, or imagery will be billed at the agreed hourly or day rate.

  • All changes must be requested in writing.

7. Client Responsibilities

To allow work to proceed smoothly, clients must:

  • Provide clear direction and required materials (text, logos, assets, briefs).

  • Approve work promptly and supply accurate information.

  • Ensure they own or have rights to any materials provided.

  • Assume responsibility for the legality, accuracy, and compliance of any content they supply.

8. Project Delivery & Deadlines

I make every reasonable effort to deliver work on time. However, I am not responsible for delays caused by late client feedback, missing assets, scope changes, or technical issues beyond my control. Deadlines may be revised if project requirements change.

9. Usage Rights & Ownership

Ownership of the final deliverables transfers to the client only after full payment is received, unless otherwise stated.

  • What clients get: A licence to use the final approved work for the agreed purpose (e.g., branding, marketing, print, packaging, website).

  • What I retain: Copyright of all created work and rights to show non-confidential work in my portfolio, website, and social media.

  • If you require exclusive rights or need the working files (e.g., PSD, AI, RAW photos), this must be agreed separately and may involve an additional fee.

10. Photography Terms

  • RAW files are not supplied unless agreed.

  • Minor retouching is included; extensive retouching may incur extra fees.

  • Location, model, or property permissions must be provided by the client.

  • I am not responsible for site-specific restrictions or limitations.

11. Rescheduling & Changing Dates

If you need to change a confirmed project or shoot date, a minimum of 5 working days’ notice is required. Any date changes requested with less than 5 working days’ notice will incur a 10% scheduling fee (calculated from the total project quote) to cover administrative downtime and lost calendar space.

12. Cancellations & Refunds

If a client must cancel a scheduled project entirely, the following cancellation policy applies:

  • More than 2 weeks’ notice: The 50% deposit remains non-refundable, but no further cancellation fees will apply.

  • Between 48 hours and 2 weeks’ notice: A cancellation fee equal to 50% of the total project quote applies.

  • Less than 48 hours’ notice: A cancellation fee equal to 100% of the total project quote applies.

  • If I must cancel a project for unforeseen reasons and it cannot be rescheduled, a refund (full or partial) will be provided for any work not delivered.

13. Weather & Unforeseen Circumstances

For photography or location-based projects, I reserve the right to reschedule confirmed dates at short notice in the event of severe weather, illness, or other unforeseen circumstances outside of my control. In these instances, we will always have an open conversation to find a mutually agreeable solution and set a new date that pleases both parties without any rescheduling fees.

14. Liability

I am not liable for loss of profits, revenue, or business, errors in final work that were approved by the client, issues caused by incorrect information provided by the client, or third-party failures (printers, hosting, platforms, suppliers). To the fullest extent permitted by law, total liability is limited to the value of the project fee paid.

This site may contain external links. I am not responsible for their content, policies, or actions.

16. Privacy

Your personal data is handled according to the Privacy Policy available on this site.

17. Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising in connection with these terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

18. Changes to These Terms

These Terms & Conditions may be updated from time to time. The “last updated” date will always reflect the latest version.
